The services comprise the libertai.io website, the chat application (chat.libertai.io), the console (console.libertai.io), the inference API and the search service.
The LiberClaw agent platform is subject to separate terms, available atliberclaw.ai.
Creating an account or making any payment constitutes acceptance of these terms.
An account can be created in two ways:
You must be at least 18 years old, or have the authorization of your legal representative, and have the legal capacity to enter into contracts. You are responsible for keeping your credentials, your API keys and your wallet confidential.Loss of access to a wallet is irreversible and cannot be remedied by any restoration on LibertAI's part.
The model catalog, the models' unit prices and their characteristics change over time; they are published in the console and the documentation. A model may be withdrawn, in particular when its publisher changes the terms applicable to it.
The applicable prices are those displayed at the time of the order. Prices displayed to consumers residing in the European Union areinclusive of all taxes, the applicable VAT being shown at checkout. Prices displayed outside the European Union are exclusive of any taxes that may be due in your country of residence.
Inference rates are expressed per million tokens processed or per image generated, and vary by model. They may change for an objective reason: a change in the cost of computing resources, a change in licensing or pricing by a model's publisher, or a change in applicable taxes. Any changehas no effect on credits already purchased or on the current subscription period. You are notified of it before it takes effect; if it does not suit you, you may terminate free of charge before that date.
Two payment methods are offered:
Accounts created with a wallet cannot pay by card; accounts created by email cannot pay in crypto-assets.
Crypto-asset transactions. A transaction recorded on a blockchain isirreversible: it cannot be cancelled by LibertAI or by any third party. It is your responsibility to check the network, the amount and the address before confirming. Funds sent to an incorrect address, on an unsupported network, or by means of an asset that is not accepted are permanently lost. The value of crypto-assets is volatile; the amount credited corresponds to the equivalent value observed at the time the transaction is confirmed.
LibertAI is not a crypto-asset service provider. LibertAI does not provide any of the crypto-asset services defined in Article 3(1), point (16), of Regulation (EU) 2023/1114 (MiCA), including providing custody and administration of crypto-assets on behalf of clients, operating a trading platform for crypto-assets, exchanging crypto-assets for funds, executing orders for crypto-assets on behalf of clients, providing advice on crypto-assets or providing portfolio management on crypto-assets. LibertAI is not registered under that Regulation and is not required to be. Crypto-asset payments are made directly from your wallet to the network; LibertAI at no time has access to your private keys or custody of your assets.
The service is credited once payment is confirmed. In the event of non-payment, rejection or chargeback, access may be suspended until the situation is remedied.
Subscriptions are taken out for a term of one month and renew automatically, with payment collected by the payment provider, until terminated.
A free tier, with limited allowances, is offered. It may be modified or discontinued at any time and is not subject to any availability commitment.
Consumers have a period of fourteen days from the conclusion of the contract in which to exercise their right of withdrawal, in accordance with Article L.221-18 of the French Consumer Code.
The LibertAI services constitute a supply of digital content and digital services whose performance begins immediately. In accordance with Article L.221-28, 13° of the same Code, by confirming your order youexpressly request immediate performance of the service andwaive your right of withdrawal for the part of the service already performed. This consent is explicitly requested from you at the time of payment.
The unperformed part — a subscription not yet started, credits purchased and not consumed — remains refundable during the fourteen-day period. Requests should be sent tocontact@libertai.io and the refund is made within fourteen days of receipt of the request, using the same means of payment.

To the extent permitted by applicable law and by the licenses of the models used, LibertAI claims no rights in the content you generate. As the models are third-party models, their respective licenses may contain usage restrictions with which you are responsible for complying. LibertAI does not guarantee that generated content is original or that it does not infringe the rights of a third party.
In order to process your request, you grant LibertAI a limited, non-exclusive, royalty-free license to the content you submit. This license is strictly limited to the technical processing time needed to produce the response, and expires at the end of that time.
The services are provided on a best-efforts basis (obligation de moyens). They may be interrupted for maintenance or updates, or as a result of an incident affecting the underlying decentralized infrastructure or a third-party provider. These limitations shall in no event apply to gross negligence or willful misconduct, or to personal injury.
Consumers benefit from the legal guarantee of conformity for digital content and digital services provided for in Articles L.224-25-12 et seq. of the French Consumer Code. LibertAI is required to supply a service that conforms to the contract and is liable for any lack of conformity existing at the time of supply.
These guarantees apply independently of any commercial guarantee and without prejudice to the legal guarantee against hidden defects (Articles 1641 et seq. of the French Civil Code).
You may stop using the services and request deletion of your account at any time by writing toprivacy@libertai.io. You may request a refund of your unused credits at that time; if no such request is made, they are forfeited when the account is closed.
LibertAI may terminate access in the event of a breach of these terms, after a formal notice that has remained without effect, except in the case of a serious breach justifying immediate suspension. Where termination is not attributable to the user, unused credits are refunded to the user.
These terms may be amended for an objective reason: legal or regulatory developments, technical developments in the service, or a change of our providers. Users with an account are informed of substantial changesat least thirty days beforethey take effect; they may then terminate free of chargeand obtain a refund of unused credits. The terms applicable to an order are those in force on the date of that order.
Any complaint may be sent tocontact@libertai.io. We endeavor to respond within thirty days.
These terms are governed by French law. Failing an amicable resolution, the dispute shall fall within the jurisdiction of the competent French courts. Consumers retain the right to bring proceedings before the court of their place of residence or of the place where the service is performed. For business users, jurisdiction is conferred on the Tribunal de commerce de Créteil (Créteil Commercial Court).

The suspended obligation resumes as soon as the event ceases; if the event continues for more than two months, either party may terminate free of charge and unused credits are refunded.
If any provision of these terms is held to be void or unenforceable, the remaining provisions shall retain their full force and effect. The invalidated provision shall be replaced by an economically equivalent provision that complies with applicable law.
You may not assign the rights and obligations arising under these terms without the prior written consent of LibertAI. LibertAI may assign its contract, in particular in the event of a transfer of all or part of its business, provided that it informs the users concerned in advance, without this affecting the consumer's statutory guarantees.
These terms are drafted in French. An English translation is provided for information purposes only; in the event of any discrepancy in interpretation, the French version shall prevail.
